Ask the Expert – When Employees Bring Tools to the Construction Site

Question:  I own a construction company. My employees often bring their own tools to use at work and I’m wondering if I’m responsible for ensuring that their personal tools are safe and Cal/OSHA compliant. I try to provide my employees a safe workplace but I don’t know if I’m responsible for checking the safety of the tools they choose to bring to work.

The answer to this question is pretty simple as Cal/OSHA makes it clear that the employer is responsible for ensuring the safe condition of all tools and equipment used by their employees (including tools and equipment furnished by employees).

Therefore, as an employer, you need to be aware of all tools and equipment your employees use, make sure the tools and equipment are kept in a safe working condition through an effective inspection/assessment process.
